Terms of Service

These terms are the agreement between you and Volka. By creating an account or using the service you agree to them. If anything here is unclear, write to us at info@volkacreative.com before you rely on it.
1. Acceptance of Terms
By creating an account, purchasing subscriptions or credits, or using Volka AI or Volka Creative services, you agree to these Terms and the Privacy Policy.
2. Services
Volka provides AI-powered tools for generating images, video, avatars, prompts, creator marketplace services, subscriptions, and related software.
3. Eligibility
You must be at least 18 years old. Volka is not intended for minors, and we will close accounts we reasonably believe belong to anyone under 18.
4. Accounts
You are responsible for your account, credentials, and all activity under it.
5. Credits & Payments
Credits are prepaid service units with no cash value. All purchases are final except where required by law. Subscriptions renew automatically until cancelled. Cancellation prevents future renewals only. No refunds for unused subscriptions, credits, dissatisfaction with AI output, accidental purchases, or failure to cancel before renewal.
6. AI Output Disclaimer
AI outputs are probabilistic and may be inaccurate, incomplete, low quality, inconsistent, or commercially unusable. Successfully generated outputs are considered delivered and do not qualify for refunds or credit restoration solely because of quality.
7. User Content
You retain ownership of uploaded content. You grant Volka a worldwide, non-exclusive license to host, store, process, reproduce, and transmit content solely to operate the Services.
8. Marketplace & Stripe Connect
Creator payouts are processed exclusively through Stripe Connect. Creators are responsible for Stripe onboarding, taxes, and compliance. Volka is not responsible for payout delays or payment processor decisions.
9. Acceptable Use
No illegal content, child sexual abuse material, non-consensual intimate imagery, unlawful impersonation, fraud, malware, or other prohibited uses.
10. Availability
Services are provided AS IS and AS AVAILABLE without warranties of uninterrupted operation or specific generation quality.
11. Security
Volka implements commercially reasonable safeguards but cannot guarantee absolute security or uninterrupted availability.
12. Limitation of Liability
To the maximum extent permitted by law, Volka excludes indirect and consequential damages. Aggregate liability is limited to the greater of USD $100 or amounts paid during the previous 12 months.
13. Arbitration & Class Action Waiver
Disputes shall be resolved through individual binding arbitration to the extent permitted by applicable law. Class actions are waived where enforceable.
14. Governing Law
California law governs these Terms.
